Terms of Service

These Terms of Service (“Terms”) are an agreement between AgentMail, Inc. (“AgentMail,” “we,” “us,” or “our”) and the person or entity accessing or using AgentID (the “Service”).
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service. If you and AgentMail have a separate written agreement covering AgentID, that agreement controls to the extent of a conflict.
01The service
AgentID lets eligible agents sign in to participating third-party applications using an identity rooted in an AgentMail inbox. The Service includes AgentID’s websites, authorization and token endpoints, APIs, developer console, documentation, and related services. We may add, remove, or change features over time.
02Eligibility and authority
You must be at least 18 years old and legally able to enter into these Terms. If you use the Service on behalf of a company or other organization, you represent that you have authority to bind it, and “you” includes that organization. You may not use the Service if applicable law prohibits you from doing so.
03Accounts and credentials
Some features require an AgentMail account, an AgentMail inbox, or an account with our third-party authentication provider. You must provide accurate information, keep it current, and protect all passwords, API keys, private keys, client secrets, recovery methods, and other credentials under your control.
You are responsible for activity under your accounts and registered applications. Notify us promptly at support@agentmail.cc if you believe a credential or account has been compromised. We may require credential rotation or other security steps when reasonably necessary.
04Agent sign-ins
AgentID authenticates an agent and provides a participating application with identity information based on the scopes authorized for that sign-in. You are responsible for deciding which agents, inboxes, credentials, and permissions you create or authorize and for revoking access when it is no longer appropriate.
Applications that accept AgentID are independent third parties. Their terms and privacy policies govern their products and their use of information received from AgentID. We do not control or endorse those applications and are not responsible for their availability, security, content, or conduct.
05Developer obligations
If you register or operate an application that uses AgentID, you must:
- provide accurate application identity, contact, redirect, and policy information;
- request only the scopes and information reasonably necessary for your application;
- clearly explain your use of AgentID data and obtain any notice, consent, or other legal basis required by law;
- protect client secrets, authorization codes, tokens, and user information;
- use exact, controlled redirect URIs and promptly remove obsolete or compromised credentials;
- comply with applicable law, these Terms, our documentation, and the relevant OpenID Connect and OAuth specifications; and
- cooperate with reasonable security, abuse-prevention, and incident-response requests.
You are the independent controller of personal information your application receives from AgentID. You may not imply that AgentMail sponsors, certifies, or endorses your application without our written permission.
06Acceptable use
You may not use the Service to:
- violate law or another person’s rights;
- impersonate, deceive, defraud, phish, spam, harass, or distribute malware;
- gain unauthorized access to an account, inbox, application, system, or data;
- circumvent scopes, consent, rate limits, access controls, or security measures;
- interfere with, overload, disrupt, or degrade the Service;
- probe or test vulnerabilities except under a written program or authorization from us;
- use credentials, tokens, or identity information for a purpose not authorized by their owner; or
- help another person do any of the above.
07Your content and data
You retain ownership of information, application metadata, logos, and other material you submit to the Service (“Your Content”). You grant us a non-exclusive, worldwide license to host, copy, process, transmit, and display Your Content only as necessary to provide, secure, support, and improve the Service and comply with law.
You represent that you have the rights and permissions needed to provide Your Content and permit this use. You are responsible for Your Content and for the legality of your processing of information received through AgentID.
08Our property
The Service, including its software, documentation, design, and branding, is owned by AgentMail or its licensors and is protected by intellectual property laws. Except for the limited right to use the Service under these Terms, no rights are granted to you.
You may use AgentID marks only as permitted by our Brand guidelines. If you provide feedback, you allow us to use it without restriction or compensation.
09Fees
We may offer free and paid features. Prices, usage limits, billing periods, and taxes for paid features will be disclosed when you order them. Unless stated otherwise or required by law, fees are non-refundable. AgentMail services used with AgentID may be subject to separate plans and charges.
10Privacy
Our Privacy Policy explains how we collect, use, and share information in connection with AgentID. By using the Service, you acknowledge the practices described there.
11Suspension and termination
You may stop using the Service at any time. We may limit, suspend, or terminate access if you breach these Terms, create risk or legal exposure, fail to pay applicable fees, or if necessary to protect the Service or others. When practical, we will provide notice and an opportunity to cure.
After termination, your right to use the Service ends. Provisions that by their nature should survive will survive, including those concerning ownership, disclaimers, liability, indemnity, and disputes.
12Service changes
We may modify, discontinue, or restrict any part of the Service and may set or change usage limits. We will use reasonable efforts to provide advance notice of material changes that negatively affect paid features, except when immediate action is needed for security, legal, or operational reasons.
13Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” AGENTMAIL DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE DO NOT WARRANT THE IDENTITY, CONDUCT, OR SECURITY OF ANY THIRD-PARTY APPLICATION OR AGENT BEYOND THE CLAIMS EXPRESSLY PROVIDED BY THE SERVICE.
14Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AGENTMAIL AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO THE SERVICE, EVEN IF ADVISED THAT SUCH DAMAGES ARE POSSIBLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITATIONS DO NOT APPLY WHERE THEY ARE PROHIBITED BY LAW.
15Indemnity
To the extent permitted by law, you will defend, indemnify, and hold harmless AgentMail and its affiliates, officers, employees, and agents from claims, damages, losses, liabilities, and expenses, including reasonable legal fees, arising from your application, Your Content, your use of the Service, your violation of these Terms or law, or your infringement of another person’s rights.
16Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Nothing in these Terms limits any non-waivable rights you may have under applicable law.
17General
These Terms and the Privacy Policy are the entire agreement between you and AgentMail about AgentID, unless a separate written agreement applies. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, merger, acquisition, or sale of assets.
18Changes and contact
We may update these Terms. We will post the updated Terms here and change the date above. If a change is material, we may provide additional notice. Unless otherwise stated, changes take effect when posted. Continued use after they take effect means you accept the updated Terms.
